1. Acceptance of Terms and Conditions

Welcome to Ardua Solutions Corp. In the T&C, the terms “Ardua Solutions Corp”, “we”, “us”, and “our” refer to Ardua Solution Corp and “you”, “your” refer to any person who accesses and/or uses the Service and Sender.

By creating an online account with us, you agree to comply with these terms and conditions, as well as any other applicable laws and regulations. If you do not agree to these terms, please do not use our services. At all times, may you request a copy of the Terms and Conditions via post or email to info@arduasolutions.com

2. Definitions:

Account: Shall mean any financial or non-financial account maintained by the Client with the Company, including but not limited to bank accounts, investment accounts, or any other accounts related to the services provided under this contract.

 

Cash: Refers to physical currency notes, coins, and any other negotiable instruments that are acceptable as a medium of exchange and can be used for transactions. Client: Means the individual, company, or entity entering into this contract and receiving services from the Company.

 

Jurisdiction: Refers to the specific legal authority, court, or arbitration body agreed upon by the parties in case of any dispute or legal proceedings arising out of or related to this contract.

 

Transfer: Refers to the movement of funds or assets from one account to another, which may include electronic transfers, wire transfers, or any other methods of fund movement as agreed upon by the parties.

 

Transfer Instructions: Shall mean the specific directives provided by the Client to the Company regarding the details of a transfer, including the amount, destination account, and any other relevant information required for the successful execution of the transfer.

3. Account Registration and Eligibility

3.1 Account Creation and information: You must provide accurate, complete, and up-to-date information during the account registration process. You agree to notify us promptly of any changes in the details you have supplied to us.

You agree that Ardua Solutions Corp can periodically validate information provided by you, using electronic address and identification verification tools and software which may be provided by public database processing companies, credit reference agencies and other sources.

 

You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You must take reasonable steps to keep the details you use to access the website and/or Ardua Solutions Corp App safe and to prevent their fraudulent use, steps to include:

​- Disguising those details if you write them down and keeping them out of sight of third parties who should not have access to the websites or Ardua Solutions Corp App or to (if applicable) your Ardua Solutions Personal Account.

 

- Not sharing those details with anyone else

3.2 Payment: Our Service allows you to send money from any of the countries in which we operate to any person or business in the same or another supported Country (the “Recipient”).

 

Ardua Solutions Corp or its associated companies reserves the right to cease providing the Services in any of the supported countries at any time and without notice to You.

3.3 Client Responsibility for Transfer Information Accuracy: To request a money transfer to a Recipient, you will need to provide proper payment instructions through the Service. This will include but is not limited to the Recipient’s full name, address, account number and Bank Identifier Code (“SWIFT” OR “BIC”), “Reference” (if applicable) and the amount you wish to send (the “Transaction Amount”).

 

It is solely your responsibility to make sure all the transaction details are accurate before submission. Providing inaccurate details, will cause delays in processing your transaction or can lead to your transaction failing.

 

In the event that you provide incorrect information for a transaction, the company shall not be held responsible for any lost or stolen funds. It is your sole responsibility to ensure the accuracy of the provided transfer details.

 

Once a transaction has been submitted for processing it cannot be cancelled except by Ardua Solutions Corp.

 

You acknowledge and agree that Ardua Solutions Corp cannot be held liable for any delay in onward payment attributable to the late arrival of funds or instruction of payment related to the cut off times to a correspondent or designated bank.

3.4 Eligibility: By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement. In order to use our services, you warrant that you will not make any transaction with the prohibited activities and industries mentioned below.

 

If you are registering on behalf of a company or organization, you must have the authority to bind such entity to these terms.

4. Proper Use of the Account​

a. Illegal Activities: Engaging in any illegal activities, including but not limited to money laundering, fraud, terrorism, drug trafficking, or any other criminal activities prohibited by law.

b. Weapons and Arms Trade: Participating in the sale, distribution, or trade of weapons, firearms, ammunition, explosives, or any other items of a dangerous or harmful nature.

 

c. Human Trafficking and Exploitation: Involvement in human trafficking, forced labor, child labor, or any activities that exploit vulnerable individuals.

 

d. Gambling and Betting: Operating, promoting, or participating in any form of illegal gambling or betting activities. e. Pornography and Adult Content: Producing, distributing, or engaging in any business related to explicit adult content or pornography.

 

f. Environmental Harm: Engaging in activities that cause significant harm to the environment, including illegal waste disposal, deforestation, or pollution.

 

g. Unethical Practices: Conducting business in a manner that involves bribery, corruption, or any other unethical practices.

 

h. Prohibited Products: Manufacturing, selling, or distributing products that are illegal or banned in the relevant jurisdictions.

 

i. Sanctioned Countries: Conducting business with individuals, entities, or countries subject to international sanctions or embargoes.

​The Company reserves the right to immediately terminate this contract if the Client is found to be in violation of any of the prohibited activities or industries outlined in this clause. In such cases, the Client shall be held liable for any damages or legal consequences resulting from their actions.

 

The Client agrees to indemnify and hold the Company harmless against any claims, losses, or liabilities arising from the Client's engagement in prohibited activities or industries.

5. Transaction Fee Clause

For the provision of transaction services performed under this contract, the Client agrees to pay the Company a fee for each processed transaction. The specific amount of such fee will be agreed by both parties prior to the execution of the transaction.

 

The Company reserves the right to review and adjust the fees established in this contract, with prior notification to the Client.

 

Any changes to the fees will take effect from the date specified in the notification.

 

The Client agrees to pay the fees corresponding to all transactions conducted under this contract, regardless of whether such transactions were authorized by the Client or not, unless the Client has timely notified the Company of any suspicious or unauthorized activity.

 

In the event of non-compliance with the payment of fees by the Client, the Company reserves the right to suspend or terminate transaction services until the outstanding payment is made.

6. Privacy and Data Protection

6.1 Privacy Policy: We are committed to protecting your privacy. Our privacy policy explains how we collect, use, disclose, and protect your personal information. By using our services, you consent to the collection and use of your data as described in our privacy policy.

 

6.2 Security Measures: We implement reasonable security measures to protect your account and data. However, you acknowledge that no method of transmission over the internet or electronic storage is entirely secure, and we cannot guarantee absolute security.

7. Intellectual Property Rights

7.1 Ownership: All intellectual property rights related to our platform, content, and services, including but not limited to trademarks, logos, software, and designs, are owned or licensed by us.

7.2 Limited License: We grant you a limited, revocable, non-transferable, and non-exclusive license to use our services for personal or internal business purposes. You must not reproduce, distribute, modify, or create derivative works based on our content or platform without our prior written consent.​

8. Account Suspension and Termination

8.1 Suspension: We reserve the right to suspend your account temporarily if we suspect any unauthorized activity, violation of these terms, or security concerns. We will make reasonable efforts to notify you of the suspension and provide an opportunity to address the issue.

8.2 Termination: We may terminate your account at any time, with or without cause. Termination may result in the loss of all account information and data associated with your account.​

9. Prohibited Countries

In compliance with international laws and regulations, you hereby acknowledge and agree that certain countries are subject to prohibitions or restrictions for conducting business activities. As such, the following is a list of countries that are currently prohibited for engagement in any transactions, trade, or business dealings under this terms & conditions.

Any direct or indirect engagement with entities or individuals from the aforementioned countries is strictly prohibited.

 

Please note that this list is subject to change in accordance with updates to international sanctions or other relevant regulations. The company shall regularly review and update this list as needed to remain compliant with the applicable laws

10. Modifications to the Terms

We reserve the right to modify these terms and conditions at any time.

If we make significant changes, we will provide notice through our platform or other means.

 

We can make changes to the T&C for any of the following reasons:

• to reflect any change in law, regulation, codes of practice or guidance, or a recommendation, decision or order of a court, ombudsman, regulator or government body, or new statements, codes of practice or industry guidance designed to enhance consumer protection;

 

• to reflect any changes in our business organization (for example, if we merge with another organization or transfer our business to another organization) or the Service Providers we use;

 

• to provide you with extra benefits or additional services;

 

• to reflect (in a proportionate way) changes in our costs in providing our services, for example changes in market conditions, technology costs, inflation and/or the costs of providing facilities.

 

• to reflect (in a proportionate way) any cost associated with any new product or service we introduce, or any new feature on an existing product or service, or any change in the Service Providers we use;

 

• to make the terms clearer or fairer to you, or to benefit you.

11. Limitation of Liability 

To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use our services, even if we have been advised of the possibility of such damages.

12. Jurisdiction

The parties shall make good faith efforts to resolve any disputes arising from this contract through negotiations and mutual discussions. If any dispute cannot be resolved amicably within 30 days, either party may initiate legal proceedings to the jurisdiction accorded by both.

13. Entire Agreement

These terms and conditions, together with our privacy policy and any other supplemental agreements, constitute the entire agreement between you and us regarding your use of our services, superseding any prior or contemporaneous agreements, communications, or understandings, whether oral or written.
